Dayall Sys is business management software delivered over the internet, by subscription. It includes point of sale, cash register control, inventory, records, accounts payable and receivable, quotes and reports.
Access is through a browser. We do not supply equipment, an internet connection or a printer — local infrastructure is your responsibility.
The official support channel is the email address vendas@dayall.com.br.
2. Registration and account
- You must provide truthful information and keep it up to date.
- The email address must be confirmed before the account is activated.
- The password is personal and non-transferable. You are responsible for actions taken with your login.
- Each registered company is independent from the others. The users you create have exactly the access you define.
3. Free plan and trial of the paid plans
Every new account starts on the free plan, which does not expire automatically and requires no credit card. It includes the point of sale, cash register control, inventory and customer records, limited to 50 sales per month and 1 user.
The limits, the conditions and the very existence of the free plan may change, with at least 30 days' notice by email and inside the system. If that happens, you may export your data or move to a paid plan, with no retroactive charge for the period already used.
Once the monthly sales limit is reached, recording new sales is suspended until the month turns over. Access to what is already recorded remains: you keep consulting past sales, inventory, cash register and customers as normal. Nothing is deleted.
Paid plans can be tried for 7 days. A payment method is required at the start of the period and the first charge only happens at the end of it; cancelling before the end generates no charge. When a subscription ends or is cancelled, the account returns to the free plan with the data preserved.
Creating successive accounts in order to get around the free plan limits is misuse and may lead to the closure of the accounts involved.
4. Subscription, billing and price changes
- Plans are billed on a recurring basis, monthly or yearly, as you choose.
- Billing is processed by Stripe. We have no access to your card details.
- Renewal is automatic until you cancel.
- If a payment fails, access continues until the end of the period already paid for. After that, the account is paused until it is settled.
- Prices may be adjusted. Changes will be communicated at least 30 days in advance, and you may cancel before the new amount takes effect.
5. Cancellation and refunds
You may cancel whenever you like, from inside the system, with no penalty and no minimum term. Access continues until the end of the period already paid for — there is no pro-rata refund for unused days.
Under article 49 of the Brazilian Consumer Protection Code, contracts entered into over the internet may be withdrawn from within 7 days, with a full refund of the amount paid.
Before cancelling, export whatever you need. 90 days after cancellation, the data may be permanently deleted.
6. Acceptable use
By using the system, you agree not to:
- Use the service for unlawful activity or to record fraudulent transactions.
- Attempt to access another company's data, circumvent the security rules or exploit flaws.
- Resell, sublicense or make access available to third parties without authorisation.
- Overload the infrastructure with automated use outside normal operation.
- Reverse engineer, copy or reproduce how the system works.
Breaching this may lead to suspension or closure of the account, without prejudice to any applicable legal measures.
7. Your data is yours
Everything you record — customers, products, sales, financial entries — belongs to you. We claim no ownership over that content and do not use it for any purpose other than operating the service.
The software, the brand, the design and the code of Dayall Sys remain our property. A subscription grants the right to use it, not ownership of it.
8. Processing third-party data (LGPD)
When you record the data of your own customers, suppliers and employees in the system, the roles under the Brazilian General Data Protection Law fall out like this:
- You are the controller. You decide which data to collect and why, and you answer for it before the data subjects and the authority.
- We are the processor. We handle that data solely to host and operate the system, following your instructions, and never for purposes of our own.
From that follow obligations on both sides. Ours: to process the data only under these terms and your instructions, within the normal working of the system; to keep security measures proportionate to the risk, as described in the privacy policy; to notify you without delay once we learn of a security incident affecting your data, with the information you need to meet your own legal duties; to help you answer data subject requests, within what the system allows, including export and deletion; to engage sub-processors only where they offer an equivalent standard of protection, keeping them listed in the privacy policy; and to return or delete the data at the end of the contract, within 90 days, except for what the law requires us to keep.
Yours: to have your own legal basis for the data you record, and to inform your data subjects as the law requires; to record only what your operation needs — the system was not designed for sensitive data (health, biometrics, religious or political conviction) and you should not enter it; to control who on your team has access to what, using the available permissions; and to respond directly to requests your customers make to you about their data.
If a data subject contacts us directly about data under your responsibility, we will forward the request to you and tell the person that your company is the one responsible.
9. Documents issued by the system
The receipts, slips and quotes generated have no fiscal value. They are proof of a commercial transaction. The system does not issue Brazilian electronic invoices (NF-e or NFC-e), and calculating and paying taxes is your company's exclusive responsibility.
10. Availability and limits of liability
We work to keep the service available, but it may be unavailable due to scheduled maintenance, infrastructure supplier failure or causes outside our control.
To the extent the law allows, our liability is limited to the amount you paid in the 12 months before the event, and we are not liable for lost profits, lost opportunity or indirect damages. This limitation does not apply to wilful misconduct, gross negligence, or any case where the Consumer Protection Code prohibits limitation.
We take automatic backups, but we recommend that you periodically export the data you consider critical to your business.
11. Changes to these terms
These terms may change. Material changes will be communicated by email or by notice inside the system, with reasonable notice. Continuing to use the service after a change means agreeing to the new version.
12. Governing law and jurisdiction
Brazilian law applies, in particular the Consumer Protection Code, the Internet Civil Framework and the General Data Protection Law.
Any disputes will be settled in the courts of the consumer's domicile, as guaranteed by the Consumer Protection Code.
